Subject: IORP II Directive: update and implications for pensions

This is a one-off extended session covering the revision of the IORP directive and the implications for pensions and sponsors. We are lucky to have three speakers, all of whom are closely involved with the ongoing reform discussions and process. This session is particularly timely given the recent commencement of the QIS process.

The session will be broken up into three session with short breaks in between, followed by a group discussion and Q&A session. The meeting will be chaired by Mark Dowsey of Towers Watson, who is well versed in the issues surrounding the review of the directive.

Session 1: Brendan Kennedy will give a general update on the current status of the IORP II Directive. In his position as Chair of the Pensions Committee at EIOPA, Brendan is ideally placed to give an overview of where we are now and what is on the horizon with the directive. Brendan is an actuary, and in addition to his role at EIOPA, he is the Chief Executive of the Irish Pensions Board, and a Board member of the Irish Auditing and Accounting Supervisory Authority.

Session 2: Falco Valkenburg will talk about the provisions of the Quantitative Impact Study (QIS). Falco is an actuary, and currently operates as an independent consultant in theNetherlands. As a member of the Groupe Consultatif (which represents the views of the European actuarial profession drawing support from over 30 countries), Falco has been closely involved with the relevant EU bodies at all stages of the IORP II discussions. Falco is currently Chair of the Pensions Committee at Groupe Consultatif, and was previously Chair of the Investment and Financial Risk Committee.

Session 3: Matti Leppala will talk about the directive from the point of view of European stakeholders, including what the future may hold and the implications for pensions in Europe. Matti has a legal background, with more than 20 years of experience in EU affairs, pensions, insurance as well as social policy and labour law. Matti is currently Secretary General of the European Federation for Retirement Provision (EFRP), which represents 22 national associations of supplementary and occupational pension funds from across Europe.

Subject: New US tax rules on foreign plans

US tax compliance has always been an onerous affair particularly in respect of employee benefit plans. As of the 2011 tax filing season, the new Foreign Account Tax Compliance Act (FATCA) imposes additional tax reporting obligations on foreign financial institutions and individuals holding foreign financial assets and offshore accounts - including foreign trusts, deferred compensation plans and foreign pension plans.

Today, Andrew Vincett, who heads up the London based US income tax compliance team at KPMG, will present an overview of the FATCA rules with a special focus on how they will apply to employee benefit plans and internationally mobile employees working in the US. This will include updates released earlier this month (September 2012) on Foreign Financial Institutions Agreements and the carve out allowed within these for foreign pension plans.

Andrew specialises in US and UK individual income tax compliance. Over his 11 years with KPMG he was worked in the firm’s New York and London People Services teams - a part of KPMG’s tax practice that provides solutions to their clients’ employee retention, reward, and mobility challenges.

The Eurozone debt crisis has had significant impacts so far and has led to a climate where many employers are under large financial pressures and face much uncertainty, which has had a direct impact and focus on benefit plans across the world. Many governments are implementing austerity measures and making changes to social security programmes and labour market reforms in an attempt to control ever rising costs. The crisis also appears far from being over.

At this opening session for the 2012/13 year, Piritta Sorsa, Head of the Division of Country Studies in the Economics Department of the OECD, will present a macro-economic perspective on the financial crisis, with a focus on Europe.  This analysis will be based on the OECD's July 2012 EU/Euro area economic survey and will aim to provide insights on the current position and what the future holds. Piritta will also cover the OECD’s thoughts on the reform and austerity agendas on the labour and benefits markets across Europe.
 
Before joining the OECD in Paris in 2008, Piritta worked at the International Monetary Fund as senior economic advisor on various emerging markets. She also worked at the World Bank in Washington DC and Geneva.

AGP will publish a global survey in May and will present the outcome of this survey during our event. The survey is held in 9 countries providing insight on how employees prepare for retirement: retirement aspirations, preparing for retirement, pension provisions and responsibility, the importance of occupational pensions, triggers to saving for retirement.

A varied panel will comment on whether retirement readiness and workforce planning is recognized as an employer’s issue. In an increasingly global market place, witnessing significant and widespread political instability, companies are pursuing business opportunities in more countries than ever before.  Employees travel or live overseas working on behalf of their company and large corporate organisations are searching worldwide for labour and resources.  Africa and the Middle East, in particular, offer substantial investment opportunities but they are also politically volatile regions with often unexpected and difficult to mitigate risks to company’s business contracts, their investments, and their key asset, the workforce.
 
As recent events in Libya, Tunisia and Egypt have demonstrated, companies need to manage their ‘People Risks’ in order to meet their contractual obligations, live up to their corporate responsibility and ensure safe and stable business operations.  ‘People Risks’ include bodily injury/medical evacuation, kidnap and the need for mass evacuation.  These perils are not just restricted to political instability but can also occur in the event of a natural disaster as we have seen in Haiti and Japan.

Simon Gilderson from Willis Group's Special Contingency Risk (SCR) division will provide an overview of this risk and what multinationals can do to manage/mitigate it.  The presentation will cover:

Indonesia is the largest economy in Southeast Asia, and has the fourth largest population in the world.

Plans for a new social security system and a new mandatory employer retirement plan are on the drawing board, medical cost inflation is nearing 15%, and employee expectations are changing.

We have decided to return once again to Brussels following the previous highly successful Conferences where we enjoyed record levels of attendance from a wide variety of countries, and very positive feedback ('A very worthwhile conference' - 'A good balance of subjects' - 'Great and smooth overall organisation' - 'Great opportunity for networking' - 'Fantastic dinner' - etc.).

We will be continuing our very reasonable pricing philosophy developed in order to attract even more delegates:

  • EUR 390 or GBP 340 – Corporate delegates (i.e. those responsible for the employee benefits of their organisation's own employees), and all existing IEBA members
  • EUR 590 or GBP 520 – Others (including consultants, insurance companies and other providers of services to employers) who are not IEBA members

The price includes all meals, including the Gala Dinner on 14 March. In addition, for delegates new to IEBA and attending the Annual Conference for the first time, the fee includes a year's free membership (worth EUR 75) for the 2012/13 membership year.

We are again including a panel discussion on the first day, and finishing early on the second day so that delegates travelling by air will be able to attend the whole conference and then have plenty of time to travel to the airport to catch their flights home.

In order to maintain a suitable balance of employers, providers and consultants attending the Conference, we are applying the same rule as last year and restricting attendance to a maximum of two paying delegates per organisation. We will be monitoring bookings accordingly, but in the meantime if you are part of a large consultancy or insurer, you may wish to coordinate bookings internally.

Whether or not Solvency II applies to pensions and captives is a hot topic for many multinational companies in Europe. The jury is still out and many interested industry bodies are involved in the consultation process on this topic.

Falco Valkenburg, a consultant and actuary with Towers Watson in the Netherlands, and who is a member of the Groupe Consultatif and the Chair of the Investment and Financial Risk Committee, will enlighten us on his perspective on this issue. He is in an ideal position to provide this perspective, as one of the observers on behalf of the Groupe of the EIOPA Workstream 2 (Solvency) discussions. This is part of the effort from EIOPA to respond to the call for advice from the European Commission on the revision of the European Pensions Directive.

Insurance contracts covering death and disability risk benefits under a single contract covering groups of employees across Europe is now a possibility.

However, some questions exist:

- What is the development of these contracts and what are their features?
- H
ow do these compare with the traditional multinational pooling arrangements?

- In what situation(s) might they be useful compared to traditional insurance programs?

- What are the advantages and disadvantages for multinational organisations, including cost and administration implications?

- How do these fit within an organisation's overall risk benefit financing strategy?


Mark Price and Janet Heaton, both Principals in Mercer's International consulting team in London, will help to answer these questions through the presentation of various case studies based on past real life multinational client situations.
